DWI IN THE NEWS
People from all walks of life are arrested for DWI, and this section presents examples of that fact. No category of people is immune -- EVEN NON-DRINKERS. This office has represented people charged after 0.00 breath tests, those with no odor of alcohol, those with nothing more than injuries in a collision to demonstrate impairment of abilities, and blood tests showing neither alcohol nor drugs.
In the rush to punish, police have been trained to assume a large percentage of drivers are intoxicated, and that they should arrest many, many people in the hope that the behavior may be deterred. Their training further tells them that many arrests prove deterrence, despite no evidence of that fact. Their training includes such ridiculous claims as this: 65% of drivers at night who make a wide turn have a .10 BAC or greater; frankly, that doesn't pass the smell test.*
Nothing on this page should be construed as condoning drunk driving, as it is clearly a dangerous activity. The public similarly should be mindful that the problem is not addressed properly by assuming guilt, nor cheating a fair process.
